Terms of Service Mixmus.com / no / org / net offers the user to make use of these services, from now on called Mixmus (provider) services. The terms mentioned below is regarding these services, unless another written agreement between the user and Mixmus exists. By accepting the terms of this agreement there will be a cookie stored with this information on your computer. Do not accept these terms if you do not accept the agreement. By accepting this agreement and use Mixmus services you declare that you have read, understood and approved the terms for the use of this service. You have to approve this agreement by marking that you have read and accepted this license agreement, or else you will not be able to use this web page. You will also have to accept that this cookie will be stored on your computer for 90 days. You will have to declare that you have read, understood and approved the terms for the use of this service after 90 days or if you delete the cookie. Service description Mixmus is a service that gives the user an opportunity to take use of third party-links, hereby called links, to music, video and song lyrics that is already published for free by the artist or record company itself. Mixmus will never take charge for the music, video, and song lyrics links that is already published for free. The user is responsible for all expenses in terms of network connection together with installation and configuration of necessary software required to use the services provided. It might occur that Mixmus will take charge of additional future services. It is also made clear to the user that all links is collected from external sources and holds a reference to the artist or company's website. The links are not under control of Mimxus and Mixmus is not responsible for any changes on an external link. Please contact Mixmus if you suspect of any criminal act, mortifying or improper information on an external link reference. Only for private use Mixmus link-service is available for anyone but it's meant for private use only, not commercial use. The user cannot use Mixmus service to sell products or a service, or to increase traffic to a website of commercial use, for example advertising space. The user cannot take the results from Mixmus and convert them, show them, or reflect Mixmus website or result site on other websites. To come to an agreement with Mixmus regarding commercial use of this service, please contact Mixmus for more information regarding this. Customers Responsibility 1) At any time comply with existing terms of use of the service 2) A valid e-mail address is required if registering as a new user of the service. This e-mail address should be personal, and one person is limited to register one account. Any changes of the e-mail address should be updated in the user profile. Mixmus takes no responsibility if user has not received updated information as a result of faults as mentioned above. 3) The user is required to keep his password unavailable for others. The user is responsible for any damages as a result of mistreatment, and is also committed to participate in helping revealing and aligning damages caused as a result of this. 4) If there is reason to believe that someone has gained information about a users account, password or similar information, user is committed to contact issuer as soon as possible. 5) User is committed to use the service in a way that does not conflict with normal way of behaving. 6) User should not use the service in a way that may involve danger or any inconvenience for the owner or third part, and also inform of possible lack of security. 7) User should not hold owner responsible for potential claims that is made by third part against issuer as a result of usage of the service that conflicts with this agreement, existing law or legislation. 8) The user has the right to cancel the agreement with Mixmus at any time by sending us a notice thru email or the membership service. Mixmus will then delete all information about the user without an unnecessary delay. Mixmus policy and responsibility 1) Mixmus have the right to close a user account if a violation in the terms of agreement is revealed. The same applies to if the service is shut down. The company/service provider have the right to block a users/customers access if there is a reasonable doubt in that this peculiar account has been or will be misused. An account registered with an invalid email address may be deleted. 2) The service provider is not responsible for material on external websites or external links. Furthermore is the service provider not responsible for errors on the client's computer or software, as a direct result by use of the service or installation of third party software on the client's computer. 3) Mixmus have the right to change the content of the service and make technical changes etc. 4) Mixmus have the right to change the terms in this agreement. These changes will also be updated and available on the website of the service (these terms). 5) Mixmus is not responsible for any expenses, damage or anything that can be regarded as a consequence of computer trouble, material or information exchanged on the offers services. The provider does not either take responsibility for loss of data, hardware failure or other unexpected events as a cause of incautious use of the service we provide. 6) Mixmus is not responsible for disruption of service due to conditions Mixmus is not in control of, like industrial conflict, public regulation, war, fire, power breakage, natural disaster, down period from our ISP-service or other force majored. 7) The user do not have the right, without Mixmus written permission, to hand over his/hers commitments and rights in whole or in parts to another person. Mixmus have the right to hand over all commitments and rights by this agreement to another firm or provider, for example by sale. 8) Provider will consecutive notify you as a user with new services at Mixmus, general improvements etc. This will be informed thru ads on the web page and newsletters to registered users. The user can at any time reserve itself from receiving newsletters from Mixmus. Dealing with users personal information The service is based on that you by yourself see to protect your confidential data from intruders. Mixmus are not in control of the data being sent or reviewed from users by use of this service and does not have responsibility for this. Mixmus will not share your password, username or other personal information to persons not concerned. Mixmus can share information about the users with advertising partners, business partners, sponsors or other third parties. Mixmus will not reveal all information about the user, and information that can identify the user will not be handed over to third parties without permission from the user. Mixmus can for example reveal information about how often a user visit the site, or frequently used links. Link references Artists and record labels who offers intellectual work on their own web spaces can at any time remove the music, video or song text if it's not longer desirable to offer Mixmus the possibility to link to their web spaces. The artists have also the possibility to protect their links if they do not want Mixmus to refer to their links. Mixmus will only link to a service, which is already published in public by the record label or the artist. Mixmus does not take responsibility of material on the artists or other external sites. If an artist or record label removes a link, Mixmus users cannot demand any compensation since Mixmus doesn't charge anything for the use of the service. IFPI vs. Truls Strandberg This article (in Norwegian) is a reference to a former lawsuit between former owner of Mixmus.com / .net / .no, Truls Strandberg, who is being accused of IFPI's lawyer to make benefit to / charge links. The reason they had to proceed against Strandberg was that he did not make it clear that the links on Mixmus only is based on links from the official legal third party sites.
